License, Acceptable Use & Resale
🚫 Acceptable Use Policy (AUP) – Strictly Prohibited:
- ⚖️ Unlawful & Fraudulent Activities: Using data for illegal purposes, fraud, phishing, scams, or malware distribution.
- 😤 Harassment: Using data to threaten, stalk, or intimidate individuals.
- 📧 Spam: Sending unsolicited bulk communications that violate anti-spam laws (no clear opt-out, deceptive headers/subjects).
- 🔐 Privacy Violations: Processing data in violation of GDPR, CPRA, or CPPA principles (no lawful basis, ignoring data subject rights).
- 💥 Network Abuse: Using data to disrupt servers or networks (e.g., denial-of-service attacks).
🔄 Conditions for Resale/Redistribution: If you resell or redistribute the data, you must:
- Bind downstream customers to an AUP at least as restrictive as this one
- Ensure customers do not remove copyright or source identifiers
- Inform customers that data is sourced from MediumAxis LLC and provide a link to these Terms
- Act as primary contact for data subject requests; forward any related to our data to [email protected]
⚠️ Your Responsibility: You are solely responsible for your use and for compliance of any downstream customers. We are not liable for misuse by you or your customers.

🤖 Artificial Intelligence & Machine Learning Usage
All datasets are offered under tiered licensing. Unless explicitly stated in your order confirmation, you are purchasing a Standard License only.
Standard License (Default)
Grants rights to use data for human-directed sales, marketing, business intelligence, and analytics only.
❌ Prohibited: Use of data to train, fine-tune, or develop machine learning models, LLMs, AI systems, or automated decision-making algorithms without upgrading to an AI/ML License.
AI/ML License (Upgrade Available)
Grants limited, non-exclusive rights to use data for training internal-facing ML models and business automation tools.
❌ Explicitly Prohibited Under All Licenses:
- Train models for public release, API distribution, or open-source publication
- Create derivative data products that compete with MediumAxis offerings
- Facilitate model distillation or synthetic data generation replicating original dataset
- Bypass data purchasing requirements through AI-generated duplicates

🔐 Data Processing Agreement (DPA)
For GDPR purposes: when you use our data for business purposes, you act as the Data Controller, and we act as the Data Processor. Our commitments:
- 🤫 Confidentiality: All personnel authorized to process data are bound by confidentiality obligations.
- 🛡️ Security: We implement appropriate technical and organizational measures to secure personal data.
- 👥 Sub-processors: We engage trusted sub-processors (cloud storage, infrastructure). List available upon request.
- ✋ Assistance: We provide reasonable assistance to help you respond to data subject rights requests.
- 🗑️ Deletion: Upon your written request or service termination, we will delete or return all personal data.

🎯 Data Accuracy & Guarantee
- 📊 List Counts: Contact counts in product descriptions are accurate at time of compilation.
- 🌐 Data Nature: Data sourced from public professional networks and third-party providers. A bounce rate of 15-20% is normal for business email data due to constant market changes.
- ✅ Deliverability Guarantee: If you experience an email bounce rate exceeding 20% on a newly purchased list, we will replace or update the list. To qualify, provide a log file of delivery errors for verification within 14 days of purchase.
